Terms of Service
This is a starting point, not legal advice. It is written to be honest about what Easybook actually does with your data, but it has not been reviewed by an attorney. Have it checked before you rely on it.
1. Who these terms are between
These terms are an agreement between you — the person or company opening an account — and Zimla (Pty) Ltd, which operates Easybook. By opening an account you accept them.
2. What Easybook is
Easybook is accounting, HR and payroll software. It keeps a double-entry ledger, issues invoices, runs payroll and prepares the returns SARS asks for.
It is software, not an accountant. It arranges your figures and calculates from them; it does not check that what you entered is true, complete or correctly classified. Returns, financial statements and payroll remain yours to review and submit, and the legal duty to get them right stays with you and your registered practitioners.
3. Your account
- You are responsible for everything done under your sign-in, so keep it to yourself.
- Each person using Easybook needs their own login. Shared logins destroy the audit trail.
- Tell us promptly if you believe someone else has reached your account.
4. Trials, plans and payment
- A trial ends by itself. We do not take a card to start one and nothing is charged when it lapses.
- Each company is billed separately, on its own plan. Opening a second entity is a second subscription, not an extra on the first one.
- Fees are payable in advance for the billing cycle you chose and are not refundable for part of a cycle already started.
- We may change prices with at least one month's notice before your next cycle.
5. Your data stays yours
Everything you put into Easybook remains yours. We hold it to run the service for you, and we do not sell it or use it to advertise to anyone. How we handle it is set out in the Privacy Policy.
You can export your data while your account is active. If you close it, you may ask for an export within 30 days.
6. Keeping records
South African law requires companies to keep accounting records for a number of years — generally seven under the Companies Act and the Tax Administration Act. That duty is yours, not ours. Keep your own copies. Do not treat Easybook as your only record.
7. Availability
We work to keep Easybook available and we take backups, but we do not promise it will be uninterrupted or error-free. We may take it down for maintenance, and will give notice where we reasonably can.
8. What we are not liable for
As far as the law allows, we are not liable for lost profit, lost business or indirect loss, and our total liability in any twelve-month period is limited to the fees you paid us in that period.
Nothing here limits liability that cannot lawfully be limited — including under the Consumer Protection Act — or for our own fraud.
9. Ending the agreement
- You may cancel at any time, effective at the end of the cycle you have paid for.
- We may suspend or end an account that is being used unlawfully, or where fees are long unpaid.
- We will give you reasonable notice and a chance to export your data before closing an account, unless the law prevents it.
10. Changes
We may update these terms. Where a change materially affects you we will tell you before it takes effect, and continuing to use Easybook afterwards means you accept the change.
11. Governing law
These terms are governed by South African law, and the South African courts have jurisdiction over any dispute.
